Short Sale Battle: Nation Star vs Nation Star I work hard and get my seller's short sale approved - that makes me a happy agent! :)I sent the approval to the buyer's agent, and that makes them happy.   This then begins the time period for the buyer to do their inspections and appraisal. Now we're on our way to our Temecula short sale closing! A little background into this short sale.  The buyer is FHA and is asking for closing costs to be paid by the seller. The seller's lender agreed to pay the buyers closing costs only on the condition that they get to do the buyers loan. OK, the buyer agrees. The seller's lender, Nation Star then counters the sales price of $285,000 to $335,000 - the buyer agrees to the counter. Got HAFA and 2 loans? Prepare for the battle. Well your short sale will be a bit more difficult for your short sale agent to get approved. It used to be that the second lender would be happy to sign off for $6,000.00 and allow you out of their loan.  Under HAFA guidelines your first lender can offer them up to $8,500.00 to release your second lien. Lately I have been running into short sales were the 2nd states they will not allow the short sale to continue unless they get the full $8,500.00 HAFA is a set of guidelines for lenders to follow, but that's just it: guidelines.  Many first lender will only offer 6% to 8% of the amount owed up to the maximum of $8.500 which ever is less to a second lien holder. With a Cal Vet short sale, we do day in and day out with the major lenders.  All Cal Vet short sale are handled out of their office in Sacramento CA. Here's a common email I get during the short sale process... Hi Sidney,   I just checked my mail at the house and found a letter dated June 11, from a lady by the name of Debra Gorham at HSBC with the subject "short sale assistance" declining the short sale offer because they have not received all of the required documentation.     I don't know if this is old information, we have been out of town for a few days and haven't been at the house to check the mail. How are short sales going to be affected by a Goverment Shutdown? If your in the middle of a HAFA Short Sale in Temecula, your in luck! See below.... The US Treasury Programs "Making Home Affordable" including HAMP and HAFA, will not be affected as these programs are funded through the Emergency Economic Stabilization Act which is mandatory spending not discretionary.  You may be out of luck if the buyer is depending on a loan that needs to be funded and the lender can not verify important information. Many of my current short sales are only 1/2 short! What do I mean?In the past, almost all of my short sales were way under water and involved two loans, a first and a 2nd trust deed.With the real estate market here in Temecula CA recovering now, many of my short sale clients are coming to me still with two loans but only short on the 2nd loan. Their question is always the same: "Can I still do a short sale when I am only short on my 2nd loan?".Yes, of course it's possible!
