I do not personally make an issue . I trust people and give good service to those who are loyal to me . If they don't want to work with me then having them sign a piece of paper is meaningless .

It is the lawyer answer “it depends.” I rarely ask people to sign one and have only been burned once. But the piece of paper is no good unless you are going to follow through and take them to court.

Yes, but would be leery of their thinking thruout the transaction. Can't understand why you wouldn't want someone to officially work for you (buyer). Makes you think they are working with multiple agents.

Have only had one buyer that refused to sign the agency agreement, and the on-line submission for their property required me to identify myself as a BA.   Could not go forward with this buyer.

I do.  I present the options as prescribed and explain it best I can.  The buyers that actually read our broker disclosure generally sign a buyers agreement with me. The ones that don't read it usually want a buyers agreement a little later.  I just try to educate the buyer about what level and type of service they get with one and without one.

Generally not. If they won't sign an agreement then it indicates they don't trust me to work for them. I will explain this to them and most sign.

Yes.  I don't do the buyer agreements.  I wouldn't sign one and I don't think they're all that useful.  If the buyer wants to screw you over, they will contract or no.  Good luck getting anything out of them.

we are listing agents and most of our buyers are our sellers....they are loyal... when we DO have a buyer to work, we do not require a buyer's agreement.... we've never been burned, YET!!!

If we know, like and trust them, and they're RWA . . . we won't ask them to sign in the first place.
IF there is a possibility that they may need to compensate us because the seller won't (off market deals, FSBOs etc) . . . then they will need to sign something that builds our fee into the deal. This ALL needs to be arranged, and an understanding reached beforehand.

Absolutely!

However, I measure their motivation by whether they enroll in the loyalty plan.  If they do not, I know they are...not committed.  I can not make it more important to me than it is to them.

Sign or not, they still must understand the compensation and willing to make right the consequences of the property they may choose.

Yes.  As long as they sign one when the proper time comes that I can turn in with final paperwork. It depends on intent of the buyer. Agents can legally perform many things ( including showing houses) without a signed BBA.
