If a situation of dual agency exists, it is the Real Estate Broker who is the dual agent. In order to have dual agency, there must be three individuals, which are the Broker and two Real Estate Agents, who are affiliated with such Broker. One Real Estate Agent would represent the Buyer and would be called an Intra-Company Agent. The other Real Estate Agent would represent the Seller and would, also, be referred to as an Intra-Company Agent.
