Website:  vonweisslaw.com  What happens if the will is older than the marriage?  The Massachusetts Uniform Probate Code (MUPC) became effective as of March 31, 2012.  Before the MUPC, Massachusetts law provided that marriage invalidates a will in its entirety unless "it appears from the will that it was made in contemplation thereof."  Pretty simple and straightforward, right?    Under the new law, things are a bit more complex.  Under section 2-301 of MUPC, if a surviving spouse married the decedent after the decedent executed his or her final will, the surviving spouse receives a intestate share (what he or she would have gotten if no will) EXCEPT that the surviving spouse does not get an intestate share of those assets passing under the pre-marital will to the children of the deceden...

The Stoughton MA real estate market is hot, hot, HOT!  According to the MLS Property Information Network, we haven't seen numbers this great since 2007...and they're only getting better. The Stoughton MA real estate 2013 year in review showed that a total of 266 homes were sold.  That's a whopping 33% more than the previous year's total.  It is also the highest amount of homes sold in Stoughton MA in a single year for the last decade, including our "boom" years of the early 2000's.  That just proves how attractive the Stoughton MA community is to home buyers. Stoughton MA Market Report Nov 2013 The Stoughton MA real estate market continues its steady climb upwards.  Both prices and total homes sold were up while the days on market have actually gone down. According to the MLS Property Information Network, a total of 27 Stoughton MA homes were sold in November 2013, making it the highest amount of homes sold during the month of November for over a decade.  This is a 24% increase from October and a 33% increase from the same time last year. The average price of condos experienced a decline during the third waurter of 2013 compared to previous years. However, more condo units are selling and in a much shorter time frame. This is good news for sellers in the Stoughton area.
