In this week's Tax Rep Podcast I discuss the IRS agreeing to extend its pilot program of the $100,000 Streamlined Installment Agreement ("SIA").For those of you unfamiliar with the SIA, it is an installment agreement where the taxpayer agrees to repay the IRS overtime.  But unlike a regular agreement, an SIA allows the taxpayer to just agree to the repayment number with the IRS without providing any documentation: no Form 433, no documentation on assets and income, and no attorneys fees!The SIA was capped so that those who owe $50,000 or less and could afford to pay it over 72 months or less were eligible.  Last speing the IRS rolled out a pilot program extending the SIA to those taxpayers who owed less than $100,000 and could full-pay over 84 months.  Trust me when I tell you, it was a...

GIven that the focus of my practice is civil and criminal tax repressentation, tax liens are something we deal with frequently.  The refrain "I would love to sell my house but there is a tax lien" is one we hear so much it makes me nuts.The reality is this: you can absolutely sell the house.  The IRS will be more than happy to allow the house to be sold.  The only thing the IRS requires is that the seller who owes money to the government not walk away with money that the IRS should have received.So if the taxpayer owes money to the IRS, say $100,000.  They also own a home worth $400,000.  I will explain exactly what the IRS will get in each of the following circumstances: Taxpayer sells and owes the bank $100,000.  In this case the IRS will get full-paid.  The house will sell for $400,0...

When it comes to tax crimes in New Haven, Connecticut, New York city or elsewhere, Tax Evasion is always considered the big kahuna of tax crimes.  So what is "Tax Evasion"?We handle civil IRS cases and criminal tax cases all over the United States, and therefore see a lot of what taxpayers do and don't do that later get them into trouble.  One thing I do notice is the confusion about what "Tax Evasion" actually is, and that most practitioners do not realize there are two forms of tax evasion: Evasion of Liability and Evasion of Collection.  More and more, the Evasion of Collection is being used to go after taxpayers, particularly when the government has noted that the taxpayer is structuring cash deposits.  Structuring is one of those crimes that many people commit without even realizin...

The focus of our practice is on civil and criminal tax controiversies in Connecticut and New York City.  An individual’s petition to invalidate four Notices of Federal Tax Liens filed against him was dismissed for failure to state a claim on which relief could be granted. Unpaid payroll taxes can wreak financial havoc for both the business and the individual owners.
