Property reassessment triggered on transfer of property to LLC Reported by Alex Gomory An owner of property transferred his ownership to a Limited Liability Company (LLC) in which he held 50% ownership as a member. Upon the transfer, the assessor reassessed the property, which in turn increased property taxes. The LLC paid the increased property taxes and sought a refund of the amount of increase, claiming the 100% change of ownership necessary to trigger reassessment had not transpired since the former owner continued to benefit financially from the property and take part in its management as a 50% shareholder in the LLC. I called a neighbor the other day to find out if she was interested in selling her home... I have a possible buyer.  She had an Agent in our area make this home available for showing today... It is not listed in the MLS, but the owner had asked her to show and handle the property. The owners have had an appraisal done, but have or will not share the results with their agent, (so I assume it is low) ... and they have not named a price for the house.  The agent said "they are looking for an offer".  How should I advise my client to proceed?  The owners paid $2Million for it.

Shop Around for your best Loan Deals..there are lots of options available today if you're looking to buy your first home, move up, refinance and yes, even the Jumbo Loan Market has relaxed a bit.  (5.88% down from 7% in 2008)In La Quinta and the Coachella Valley, we have MANY local lenders with tremendous knowledge and the willingness to sit down and explain your options to you..very carefully.  These are just two that I work with regularly and my clients are very satisfied. The Surprise Tax Investors contemplating a 1031 exchange are usually focused on the capital gains which are taxed at 15%. However, they often overlook "recaptured depreciation" which is taxed at 25%. As this tax is based on the total of all the depreciation taken over the years, it can in many cases, particularly with lower gains in today's market, more than offset the capital tax benefit, if not structured correctly.  For example, a house purchased in 2000 for $100,000 is sold for $120,000.  After closing costs, the capital gains are only $4,000.  At 15% Federal Tax Rate (ignoring State Taxes), this would only be $600 in taxes.  However, the recaptured depreciation is $36,364 and the tax on that amount is $9,000.  Surprise!  Make sure your 1031'a are structured effectively to defer bot...

According to todays Desert Sun-- The real estate world was very different in the Coachella Valley five years ago. Prospective buyers streamed through model homes while real estate agents poked pins onto maps to reflect constant sales — some posting $10,000 price gains by the month. Phones rang incessantly. La Quinta, California;  Did you Know?  The City of La Quinta is known as "the GEM of the Desert.", and it is.  In 1982, La Quinta was named for the resort opened in 1926 by Walter Morgan..La Quinta Resort & Club.  Still here, operating and a huge "snowbird" draw, the hotel is only part of it..When the floor of the valley first began sinking, it was covered by the Pacific Ocean.  Over a period of hundreds of years, the Colorado River flowed into the Gulf of California and deposited silt, forming a large delta fan.  The silt deposits got larger and larger until the shrinking basin was cut off from the ocean.  Five hundred years ago, the Colorado River changed it's course and flooded the east Coachella Valley, creating the freshwater lake called Lake Cahuilla.  That same lake's water line ...

As reported in The Los Angeles Times, the Internal Revenue Service (IRS) recently issued new guidelines and clarified documentation that taxpayers must submit to successfully obtain the federal tax credit for home buyers. The federal tax credit for home buyers was extended and expanded late last year.  Qualified first-time buyers may be eligible to receive a tax credit of up to $8,000 on homes purchased before April 30, 2010.  Repeat buyers may be eligible for a tax credit of up to $6,500. La Quinta's Farmer's Market...come on out!  Old Town in La Quinta has developed into quite the local hot spot for La Quinta residents of the La Quinta Cove area, including visitors staying at both the La Quinta Hotel and also Embassy Suites Hotel.  Each Sunday through about mid-June, the main street is a walking, moving jumble of people, vendors, store owners, restauranteers, dogs and kids.  There are tents with fruits, vegetables, cheese, nuts, flowers and fresh baked goods.  Organic, fresh, colorful selections sold to you by the actual growers or other family members for the most part!Last Sunday, sitting at my desk at HK Lane, where the doors open onto La Quinta's main street, I was watching the people stroll along enjoying the sunshine when suddenly one of the Vendor's backed their ...

  La Quinta and Coachella Valley Speculators vs. Investors.    I have mixed feelings about the affect Speculators are having on our California market.  Investors in La Quinta and the Coachella Valley, are basically defined as Buyers that purchase a distressed property, rehabilitate it and sell it at a reasonable, market supported profit.  Speculators in La Quinta and the entire Coachella Valley are basically cash buyers that buy an REO property and either flip it very quickly or rent it until the Market increases.  This can actually depress Sales figures because they often buy at Auction, thus lowering the statistics.  BUT, in La Quinta for example, I am always happy to see Investors..let them make a profit!  I find that their properties are priced within market ranges and in the low to...

I wondered if I could gain Facebook Fanpage Friends...by posting a blog on ActiveRain... my fan page is all about Living The Desert Life... and is a direct link to my site about all the fun, cool, happenings in the Coachella Valley desert.
