Divorce Real Estate In divorce real estate two spouses seek to divide their assets 50/50. That normally is the goal, however that is easier said than done.  But have you ever heard there is more than meets the eye? A lot of things in life are like that and divorce is no exception. Much of what I know in this area was taught to me by my mentor and Professor Kelly Lise Murray J.D. from Tennessee who currently teaches at Vanderbilt University Law School and who spoke as the Main PlenarySpeaker at the 2010 American Bar Association Convention last April on this very topic. There are 5 risks for folks who are divorcing as it pertains to their real estate. Physical,Financial, Legal, Emotional and Economic. For me these stand for Please Fully and Legally Expose Everything. More on this in a min...

You won't. I could actually stop there, but since that's not an entirely accurate statement, let's examine the question since it comes up so often. What defines a "bottom"? Is it the number of homes sold? Is it the price homes are selling for? Or is it the number of homes on the market? These are all great questions, but you'll find that the answers aren't always clear. If we're going to judge the bottom of the real estate market by the number of homes sold, then the bottom is behind us. We have seen year-over-year gains for several months now in our local market, and many markets throughout the country are experiencing the same thing. So if sales for December 2009, January 2010, and February 2010 are all higher than December 2008, January 2009, and February 2009, then you would have to...

The real estate market today isn't what it used to be a few years ago. Worse than that, it isn't what it was a few months ago! Everything changes so fast these days that it's difficult to keep up. With new laws and regulations, with HUD, Fannie Mae, Freddie Mac, the Federal Government, state legislature and local jurisdictions changing the rules almost on a daily basis, knowing the in's and out's of a even the simplest real estate transaction is no longer simple. In fact, it's just about impossible for a Realtor to memorize all these changes because by the time they do, those changes will be outdated! The irony of course is that most sales, particularly distressed properties, require a certain amount of legal knowledge, a trait that although may seem advantageous to a Realtor is actuall...

Important information provided by the California Association of Realtors Undisclosed Short Sale Payments May Be Illegal "Undisclosed payments in short sale transactions, especially those paid outside of escrow, may violate the law, including RESPA, laws against loan fraud, and licensing laws.  Short sale agents have increasingly reported to C.A.R. about requests for agents and their clients to pay junior lien-holders and others, oftentimes outside of escrow. One common scenario is when a short sale seller's senior lender authorizes a payment of $3,000, for example, to extinguish a junior lien, but the junior lender demands that the buyer pays an additional $9,000 outside of escrow.  Not only would it be risky for a buyer to pay outside of escrow, but concealing this additional payment...

In the past sixty years or so, Americans and Huntington Beach home owners have made a shift from the practicality of their parent's generation to the preference of their own. For many people, size, status and sparkle took precidance over strength, stability and savings. Unfortunately (or fortunately), that practice just isn't sustainable for long. Now that the economy is starting to settle it seems like people are heading back to the philosophies of yesterday. Many folks seem to be shifting the ways they spend and prioritize to better represent their needs rather than their wants. An article in CNBC's column Realty Check with Diana Olick makes it very clear that this applies to more areas than many of us might realize.  Diana proposes that our frugality is even flowing into the room wh...

Recently, there have been reports claiming that a "strategic default" can be an appropriate and even beneficial reaction to an upside-down mortgage or impending foreclosure.  While this idea has spread rapidly, the truth is that a default is never an easy road to choose, and rarely is it ever strategic.  In fact, defaulting on your mortgage can be incredibly dangerous and irresponsible when handling the financial future of you and your family.  Unfortunately, the ramifications of a "strategic default" are rarely---if ever---explained, leaving many homeowners stranded on an island of misinformation. If this is your situation, first understand that you are not alone.  Millions of homeowners nationwide are in similar circumstances.  The only difference between them and you is that you're ...

Who lives here, Popeye the sailor man or Jack Sparrow? As I was doing my normal Huntington Beach Real Estate research this morning I came across an article from the OC Register's Huntington Homes column about a very interesting listing. I'm normally all about interesting properties especially the ones that feature practical designs or modern styling. This one however, made me wince. Twice. We've talked about how much creative license a person can and should take with their home before and I'm sure the topic will come up again because it's so much like watching a car accident or someone hurting themselves on YouTube. It always comes back to seeing something painful or odd. Last time, the topic was a home in Huntington Beach styled to look like a castle. The owner of that property had a ...

Huntington State Beach Lifeguard Requal – A Chilly Day The Huntington State Beach Lifeguard try outs were yesterday at lifeguard headquarters yesterday morning. The air temperature was 55 degrees, and the water was in the high 50’s. My daughter Heather Thomson participated in the requalification swim yesterday.  I enjoy watching and encouraging these candidates who braved some less than optimal conditions yesterday. Not only was the air and water cold, there was a strong current, and choppy conditions. One of the candidates said because of the chop, it was difficult to get a rhythym while swimming.   There were two events. The returning guards requalify with a 1000 yard swim which must be completed within 20 minutes. They swim out around the buoys, back to shore and run to the finish li...

I've been a dog owner most of my life and my pets have been a huge part of my life and a great source of enjoyment. Now that none of my companions are still around I thought I might take a break from the difficulties in owning an animal. Contrary to what I thought when I was nine, you're right Mom, pets are a big responsibility. I think many pet owners in America didn't really know what they were getting themselves into before taking their first pet into their home. Just watch the Dog Whisperer and you'll see what I'm talking about. So many people aren't willing to commit to other people but don't think about the consequences when committing to a pet for what could be fifteen or even twenty years.  Statistics show that 39% of all american households own at least one dog and 33% own a ...
