Hi Richie. You did not mention if your garage was locked. ALWAYS Keep your classified documents in a LOCKED garage and you will be GOOD TO GO! That should be sufficient for distraction of thieves and your classified documents will be completely safe. 😀

First, we all need to know, have you ever asked, "How can anyone be that irresponsible" about anyone else holding classified buyer documents in an inappropriate space?  If so, you answer your own question.  If not, just hire a lawyer to destroy the most classified documents and move on.  😉

I keep them safe and sound next to my porn collection starring me and underage foreign nationals, and of course my crack pipe 

I keep files FOREVER but shred any sensitive documentation . . . 

AZ says 5 years after COE. Escrow keeps for 4 years and then destroyed.

If you are past the number of years that your state requires retention, throw them away. If not, perhaps you could clean out your garage and ship them to someone with a larger garage to keep with their classified documents.

For any Nonpublic Personal Information (NPI) records in my custody, I follow my industry regulations, privacy laws, and data protection laws, which are incorporated in my written Privacy Policy and Written Information Security Policy (WISP).

More states are passing consumer data privacy protection laws that apply to their residents, even if they are doing business in another state.  California has the California Consumer Privacy Act (CCPA).
Colorado has recently passed the Colorado Privacy Act, effective July 1, 2023.
Negligent security practices for keeping NPI records may result in liability.  If data privacy and protection laws are being violated, liability insurance would not cover the claim.

In Florida, you only have to keep documents for five years, so I would shred them.  Keep or destroy depending on the laws of your state.

Richie Alan Naggar - this is such a sensitive topic that could have grave consequences. I wonder how long it will take for NAR, Brokers, and State Associations to have mandatory classes on this highly sensitive subject for all licensed REALTORS? Everyone should ask themselves, am I covered by E&O?
