Last week I watched a 20/20 episode about a serial killer...he was a well respected real estate broker who enjoyed killing people...if I remember correctly, he spent some time prior to that in jail for something.
Yesterday, I read about some broker who admitted to fraud. (renting property he did not own and keeping the money) He was fined $21,000 and license suspended for a mere 1 year...

I guess it depends on state by state rules. I was arrested as a wee lad in 1974. I know people are going to speculate, so set the speculation aside. I assualted a police officer. It was eventually reduced to drunk in public. When I filed for my VA license, no problem. VA had destroyed the record in 1978. When I went for my WV license, the WV State Police held me up for 5 months. MD didn't even look at it. Ironically, the FBI is still trying to figure out how the WV State Police found that old record that VA had destroyed 40 years before. All of those state licenses were broker's licenses.

I know of real estate agents who had adjudication withheld or slap on the wrist for DUI, minor possession of dried smokeable leaves, and other youthful indiscretions. For that matter, I know some members of the Florida Bar who had minor convictions / misdemeanors in their background.

Misdemeanors will be allowed however, they look to see if the boo-boo is related to morals, ethics etc. Whatever they do, it is negotiable & appeal-able if borderline or denied. Interesting to note that violations made during or after a licensing are held to a much higher standard.

In Texas it depends on the crime. If fraud was involved a license will not be granted. Other crimes are handled on a case by case basis. Many time they will issue a license but the agent will be on probation.

Traffic infractions are usually ignored however the devil is in the details of anything else. In state or out of state convictions it's best to list ALL misdemeanors and/or felonies. The Commission will generally set your application aside until the next monthly meeting to make their determination whether you're a GO or not.

In the news, the last three real estate agents who went to jail had felony convictions prior to getting their license. Yep, felony convictions for 'fraud and fraud-like' activities. And history did repeat.

An FBI check will determine whether a real estate license will be issued. Admitting to DUI offenses/jail time/police record/current criminal investigation is required prior to that or no go!
But then...
I remember the RE broker in South Carolina who kidnapped and raped a 14 year old as a 15 year old, spent 14 years in prison. He said it was trumped up, got his broker license, then killed 7 people and chained a woman to shipping container for 2 months until someone found her.
