A seller who refused to return earnest money after a buyer exercised his right to terminate the contract. The issue went to mediation and an incompetent mediator thought it best to split the money. Clearly he never understood the issue. It was resolved in the buyer's favor in arbitration.
Never used mediation again! The cost was a non-refundable burden on each party.
