Because it's the law and I would not want to lose my license or have it blemished...if I where still active  (there are certain cases where it could be paid, i.e. commercial real estate...check your state law and if it would violate RESPA rules).

It is unllawful.

However, it is done more often than 'professionals' will admit.

The recipient is simply cloaked in the guise of 'lead generation.' There are MANY companies being paid referral fees who should not be. Just about any RELOCATION company to which an agent pays a referral fee fits that bill.

You do need to be clear if 'referral fee' is a form of  contingency payment disbursed by the closing company at the time of closing or whether the postal worker received a gift card for bird dogging for an agent.

I think they should be paid so you can get more of these unethical agents out of the business to pave way for those willing to follow the law. When you have questions like this it is always best to refer back to your law manual for your state to see what is legal and illegal.
