It has not always been that way. Laws change for a reason.  It makes sense that a person/agent have some experience before becoming a broker and able to "manage" other agents. Otherwise, it is the blind leading the blind.

Sales People have to be associated with a Broker because of Real Estate law. They don't want it to be like the Wild West; there's got to be some accountability. 

On your 2nd question, I am not aware that you must work as a Salesperson before being allowed to get a broker's license, never looked into it, never heard it before- but assuming it's true (because it's been said in Q&A) I would think it helps to work in a business & grow your own after understanding what Agents do; after all you'lll be managing them & it helps if you walked in their shoes for a few miles 1st.

In Oregon every new agent is a Broker.  However, they must be affiliated with a Principal Broker for the first 3 years to gain experience and have someone with real estate knowledge supervise their work.

New agents especially need a broker to supervise their activities. I have been in the business 38 years and still learning each day but know a whole lot more than a brand, spanking new agent. Experience really is a good teacher and you need time under your belt learning and getting more education before you are ready to be on your own or supervise others..

In my state, agents are required to work under a broker if they want to practice real estate. To get a broker's license, Florida requires that an agent be active for at least 2 years out of 5 so they have actual on the job experience before becoming a broker.

Because there are things called laws, and you must follow the law to practice.

You can't go right to a broker license because you have to learn the business first and the law wants someone to teach newbies the law. Think of it as an apprenticeship.

I was curious what is Caldwell Banker, from your profile, because I've never heard of that. I also can't find your name and affiliation on the UT Real Estate Commission license lookup, there is a Tammy Jensen that expired in 1997.

Think of it this way, would you want to run your own real estate company before you even know how to fill out the forms or work with clients?

Many realtors in CA start with a broker license. It needs a college degree and two years related experience which can be anything substituting it.

Once you have a broker license you ask a realtor how do you fill out a form? Where do I get leads?  

At anyrate it is just a piece of paper hanging on the wall. Can not use it? Why bother?

It is a sort of checks and balances where the broker has some accountability for what the agent does,  a supervision of sorts.

You can get a brokers license pretty quickly with some experience.
