Here in Florida, when a back seat passenger pulled out the cell phone to record a police encounter, the police said it was ILLEGAL because of the audio and lack of his consent.

Well, we see how that turned out.

Hmm, isn't this very much like GOOGLE spying on your internet activities? The argument in their defense was, "Only those doing bad things need to be concerned."

One could rephrase 'If the abundance of ones heart is dark, they should take care regarding the words they speak."

No.  I actually had a conversation with an attorney one day to discuss this since clients may have video cams in their home during showings.  He advised that they disable the sound while potential buyers are at showings.

Here in AZ I think it depends on the location, if you are in a public place or in a private place.  I think in public you can record and in private you need permission.  Have to say I have never done this, as I do not have personal experience Buzz Mackintosh, so this is my understanding.  I will check below and see what Candice A. Donofrio says, because she would know for sure.  No clue as to what any other state might require.

Under Maryland’s Wiretapping and Electronic Surveillance Act, it is unlawful to tape record a conversation without the permission of all the parties. Additionally, recording with criminal or tortuous purpose is illegal, regardless of consent. The state also prohibits the recording and disclosure of images intercepted in violation of its privacy laws. Violators can face both civil and criminal penalties.

In-person conversations: The state requires all parties to a conversation to give consent before one can record any private oral conversation. Md. Code Ann., Cts. & Jud. Proc. § 10-402. State courts have interpreted the laws to protect communications only when the parties have a reasonable expectation of privacy, and thus, where a person in a private apartment was speaking so loudly that residents of an adjoining apartment could hear without any sound enhancing device, recording without the speaker’s consent did not violate the wiretapping law. Malpas v. Maryland, 695 A.2d 588 (Md. Ct. Spec. App. 1997).
