"This is not a solicitation to list any homes currently listed with another agent". That or something similar is what i usually see. Although, there is no requirement to include that wording, but many agents still use it. It's no different than putting an ad in the newspaper that goes to your farm area. If someone sees your ad, and their house is already listed, then it's doubtful that they will call you.

We used to have to write disclaimers in our direct mail such as 'if you are currently listed, this is not a solicitation..., blah, blah, blah.....' which was entirely stupid. Of course, it' a solicitation.
And every year, the Dept of Real Estate would get a flood of complaints. So, they did away with that. Who cares? So what?
