YOUR agent should be delivering the contract to the appropriate entity to open escrow.  Call your agent and find out what's up.  Sounds like they're slacking and could be in violation legal requirements.

I don't see your location listed and SO MUCH about real estate is dependent on where you live.  In So Cal, the listing agent sends everything to escrow and escrow works with title to get them what they need.

My initial thought was, who cares, just someone get it there. Then after reading answers and thinking about it, I came up with the buyer's agent should get it to the lender (assuming it is not a cash deal), and the lender will then have the contract to the closing attorney/title agency. Regardless, just someone get it to where it needs to go. If it is you, do what you need to do to get your property, and then seek advice from an attorney how to report the situation, if that is the path you want to pursue. I am sorry to hear you are in this situation.

I'd say that's a discussion between you and your agent, to understand this question but also the purchase process in general. There is a lot of educating that should go on. The process might vary from state to state. Here in SoCal this would normally be the listing agent's role.

Has the escrow already been opened? In our market, the escrow is often opened prior to contract agreement. If I am the agent who opened the escrow, I send the contract to the title/escrow company. If the other agent opened the escrow, I get the contact info for the title/escrow company and find out what the want. If they need the contact, I send it to them. Your agent needs to cover all bases.

If someone is waiting for an executed contract in order to open the escrow, they need to get on the ball.

I don't work with title companies... so can't answer that. I always send ratified contracts to my settlement attorney on behalf of my clients, be they sellers or buyers.

Typically the person who executes the contract is the one sending to title.  However, I always follow up regardless whether I'm the agent executing the contract or not.

Paul, you need to talk to your realtor if he or she is not doing his/her job.

we use attorneys not title companies and since the seller signs last, the listing agent would disperse agreements to all parties including the attorneys/title company....

When an Agreement of Purchase and sale is accepted here, both agents receive a copy of the Agreement, as well as the Buyers and Selles.  The admin in each of the brokerage offices, sends the paperwork to their respective lawyers representing their clients.

In CT it is an Attorney state, so whether we make the contract up or the attorney does, the Agent's responsibilities are to make sure everyone has a copy of the Summary Sheet & the deal paperwork. Attorney's handle the title co. Buyer's Agent, Buyer's Attorney or Seller's Agent will deposit the Earnest Money in their Escrow account & forward funds to the attorney in preparation for closing.

Our process works differently, as we are an attorney state. That being said, you should hold your agent responsible for representing you, regardless of who is "supposed" to send the contract in.
