I can not say that I've seen false advertising in our Real Estate market Bryan UNLESS you are talking about some of the agents using 20 year old pictures of themselves in their marketing. Then some guys are very disappointed when they call and meet said agent .

Not blatant or intentional. But I know a Broker who is facing a civil suit for selling a "prime commercial lot in northeast Tallahassee". Said lot is actually in Lake Protection zoning, you can only build one residential house on that lot, nothing commercial. The investor/buyer who paid $500K wants his money back.

When I think of false advertising - I think of the pervasive, inaccurate home values on Zillow, Trulia and the like. We have a remedy to that - it's called Seller's Corner. Keeping leads and clients away from listing syndication sites/portals is a great step toward curtailing the mayhem that stems from ad/listing misrepresentations. - Tim

We have a local real estate company spewing BS that they are the number one local company when everyone in the business and community knows otherwise. Zillow is the poster child of false, deceptive and misrepresentation in advertising. Agents of the highest real estate ethics flock to write checks to the tune of $1,000 to become partners with them.
Brokers advertising 2%, agents offering rebates and Open Door are all practitioners of playing to greed, fear and dislike. The defend by saying the small print takes away the promise.
As long as agents have surrogates they can hire to offer inducement's and make misleading statements, there will be no control.
All that exists is a blockhead organization pretending to be the guiding light while the minions chant "raise the bar: and sing 'we got ethics' the real-estate world carries on with those who are relevant in the business.
Fix the brokers, and you can fix what is broken.
I do not think in this forum there would be consensus on what is false advertising. ALL agents are GUILTY of publishing success theater, vanity metrics and surrogate endpoints. Fake, fake, fake. Some should say THAT is false advertising.
Evolution, and we are at a punctuated equilibrium, will be the hand that changes these dynamics and raises the gate to free agents from a false belief they are doing it right.
Do not look to the past to predict what is about to happen in the near future of real estate. Look and listen to what home buyers and sellers are saying to non-real estate people.
Then look at what lenders are doing to impose their will and influence. It could be of benefit to see what Warren Buffet is doing with his multi-billion dollar investment in making sure he is on the wave and not to be swept away by it. His effort is to secure Hathaway's relevance in a disrupted economy, not necessarily to interrupt his enterprises assets.
