"As-Is" is the most mis-understood term.  Sellers don't understand it because their agents don't and can't explain it ... or it is explained incorrectly. 

As-Is means "as known, as disclosed, at the time the offer is accepted. Any material fact not disclosed and discovered after the offer was accepted opens the door for negotiation. The seller is NOT obligated contractually to offer an concessions.  

This is why we do as much due-diligence as possible prior to writing an offer.

Our residential contracts recently changed. They're more like California's now. Buyers are more like California's now too. LOL 'Sure it's as is, until we start squawking and ask for a billion repairs'. Seller might do them, or tell you to GFY. You don't know, and you shouldn't expect. Everything you said 1--> 4 is a yes. And there's so much more. I will add, whether the property is being offered 'as is' or not, the same amount of due diligence goes into everything.

I typically tell my clients that "as-is" means whatever the seller wants it to mean. The lender will ultimately determine if it's really as-is. For instance, a home with black mold is only as-is if you have a cash buyer. A house without a working heat system is only working for a cash buyer. So, as-is is sometimes relevent depending on what's wrong with it. I have listed a few that were as-is, and in the remarks I mentioned that the seller did not have the means to make "any" repairs. None, nada, zilch. Each one of those has sold for cash with no repairs requested.

I explain to my Buyer that nothing is warranteed or guaranteed and they would have to accept the property as it stands.  I would advise them to have a home inspecton prior to submitting an offer to try and determine what the deficiencies are, and the approximate cost.  I would also have them sign a waiver that I notified them of the meaning of "as is" and they are proceeding of their own volition - "CMA" cover my a*#

5.  Anything can be negotiable is what I would advise my Buyer, and Inspections are crucial Annette Lawrence , Palm Harbor, FL 727-420-4041.  For Me:  one, it would mean there is a strong possibility that the Seller wants to fix nothing and either will not or cannot put more money back into the house; two, it would mean that there is a possibility that what you can 'see' is one thing, and there many be things that you 'cannot see' that could become issues or deal-breakers.  It may just be deferred maintenance or a can of worms, so to speak!  I will read replies below.

It would depend a lot on the property, it would depend on the condition of the property, it depends on the listed price, and perhaps a few other terms. Generally, it does not mean much. It's the seller's message that the property would perhaps require repairs and intentions not to provide those repairs, or a seller situation. All and all, everything is negotiable, and it 'all depends'...

Our NC Contract is as-is but, buyers still perform their Due Diligence and ask for items. Sellers have the option of making repairs or standing firm, making no repairs. 

If my buyers can handle the cost of the repairs or stomach particular issues, then they typically move forward. If a seller rejects repair request, we typically already have a contractor's ball-park estimate on items that are hot points for buyers.

In CA all properties are as is, per the purchase contract.  Doesn't mean you can't do inspections and ask for stuff.  Doesn't mean the sellers will or will not do repairs.

 

Oddly enough, out here the sellers don't even have to respond to a repair request!

     You the Buyer have a 15 day "Free Look" to check out the property - then we can ask for repairs (re-negotiate), or back out of the deal, or just proceed to closing.

It's AS IS With Right to Inspect but most use it as AS IS With Right to Negotiate.  

I tell the seller that while you ask for AS IS, buyers will do what they want and you will respond as you want.  Price your listing based on the condition of the property comparable to others and disclose all know material facts.

I tell buyers that they have xxx days to inspect and release the contract or inspection contingency.  I tell buyers to put in your higher and best offer.

Having said that, negotiating over a few dollars is just a waste of time and often leads to disappointment.

Lots of great answers here! I advise that is means just about whatever any party to the transactions takes it as. I have seen sellers of "AS-IS" do repairs, and I have seen them respond with, "It's being sold AS-IS." All you can do is ask for something and see how the seller responds.

In CA properties are sold AS IS, as disclosed however everything is negotiable in real estate and it doesn’t mean buyers can’t ask or sells can’t credit or repair.

I explain the purchase contract at the time of listing so the seller is aware of the AS IS and what it means as well as sitting down with a buyer in advance of viewing property to explain to them what they will be signing and what it means to a buyer.

Contracts are different depending on where the contract is written and buyers coming from out of area might be used to something entirely different. 

It all comes down to the specific situation and nothing can take the place of proper education.

I have many cash buyers and I tell them to get inspections for anything that concerns them. Most recently this past week, buyer did roof and pest inspection. Seller was willing to renegotiate based on some findings no one was aware of. "As is" is great if negative items are known and taken into consideration when coming up with a sales price.

I would say #2.  No matter the intent of the seller a buyer can ask and seller never HAS to repair, but I advise to have it inspected and proceed from there if they think it's THE house.

I advise while it is an "as is" contract they will be purchasing an option period where the pay x number of dollars for x number of days and they will  have the option to terminate for any or no reason.

As is means nothing in most cases.   

In reality, one can not legitimately ask for repairs for known disclosed issues.  But, for all of those hidden and undisclosed issues, it's fair game.

As is.. just as anything else the seller has in the listing is open to negotiation. Just because a seller wants to sell as is doesn't mean the buyer has to write their offer that way. Sellers can put anything that is LEGAL in their listing. Buyers can ask for anything that is LEGAL in their "Purchase Agreement".

While a seller may like to sell their property "as-is" our state disclosures require answers and sellers' agents are responsible to dig a little deeper when the seller doesn't know or doesn't want to know.  Depending on the agent, I advise my buyers that we will be proceeding with caution, asking for what we want knowing that might not happen, and calculating risks along the way.
