Realtor Code of Ethics

Article 16

REALTORS® shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORS® have with clients.

I would think the agent and their managing broker would be getting an email that would document this unethical behavior.  I would be sure to cite from COE, and send the link to it, as well as attach a pic of the materials in house (to avoid disputation).  I would also take note of it so that if this agent phones for showing of any of my future listings, I would be sure I meet them at property.

Regardless of whether you tour your listings or not, that certainly sounds like an ethical violation and in many MLS systems an MLS violation as well. In our local MLS we have had several Pro Standards cases heard where agents have represented a listing as being their own by promoting it in marketing materials without the listing agent/brokerage permission.

I'd think that agent is a desperate soul.... I'd remove it.... I'd most likely call that agent and tell them to come to my office and retrieve their marketing materials.... I have no use for them....

That is beyond tacky and passes into the realm of unethical.  That agent and broker would be hearing from me and, trust me, I'd be doing the talking and they'd be listening! Depending on their response, the MLS and/or State Dept of Licensing would also be hearing from me.  

I've been told I could tell someone to go to Hell and they'd look forward to the trip. They'd be looking forward to that trip!

I would think that this person just wasted a bunch of materials that I will be taking along with me.

Now you have to visit your vacant listings more often.

I would toss the stuff...but become unglued?  NO! 

File a senseless complaint? NO!

Make a big deal out of it?  NO!

If I had a bird cage I would use it to line the bottom of it. Then I would call the agent's broker to alert her/him to a possible ethics violation.

I think I would not be thinking much when I hit the ceiling...... Call the agent's broker?

I would pack it up and send to their broker on the off chance the broker would not want an agent doing this kind of thing.  

I would remove the promotional material and mail it back to the agent with a very stern warning from the NAR Code of Ethics (if they are members).

Then I would just forget about it and make sure not to spread ill-will about them. Nothing good comes from more gossip.

What I would think is not appropriate for this forum. However, be assured we would have a little talk!

I have seen similar materials left by the buyer's agent even when the property is occupied. 

I'd think about reporting them to the proper authorities.

This would infuriate me!   Call them and let them know this is a violation and throw their crap in the trash! 

That happened to me at listing in Haymarket. The agent left several of her business cards and fliers that said " If you like this property, you should visit my listing nearby at 123 Main St." No refrigerator magnet though. I just removed them.

Wow, That goes again ethics I would think.  I had a agent replace my flyers one time out in the box with his.

Take photos and send them to their broker with a long letter about how un-professional that is and CC them on it.  Include a copy of the complaint filed with the board and the state association.

Lack of class nd ethics on that agent.

I would think "typical".

I would definitely have a chat with them and possibly their broker.

I would have my broker contact their broker and I would probably contact the local board. This is an ethics violation.

I would doublecheck the address first!! 

I'd just throw the stuff out. As to the agent, I'd file them in the "naughty" section of my mind and if I saw them again, I'd probably mention it.

I would be taking photos and making some calls. I am sure some Codes have been violation and this agent needs to learn.

I would not think. I would be on teh phone to said agents Broker and it wold be done or I call the state.

I would be talking to my broker and having my broker call their broker about crossing a sign. If they did it to one they will do it to another.

After I put all the material in the garbage can I would place a call to that agents broker.
