Sound like to me the agent who said she'd get sued was in bad way for her commission at all cost including a vile threat of consequences to the seller. 

And sounds like the listing agent is the one to get sued for misleading the seller, for gross negligence, dereliction of duties and obligations to the seller, dishonesty, malpractice, and shit for brains.

I had a client call me once, while in escrow with another agent and a huge problem. I had sold her the house, stayed in touch and she went behind my back with a discount broker. I said, "I' wish I could help you but I'm no longer your agent apparently and by the way, I'd never have gotten you into that mess had you come to me to list it, good luck and buh bye!"

Yes, very vindictive but I was in shock that she'd betray my services, I got her a hell of a deal on that house in the 2007-short sale days.

Call a great real estate attorney who specializes in short sales. Sounds like the LA was asleep on this one...that should have been known from the beginning and certainly a review of the CD would show the shortage.

That agent is not experienced in default real estate situations, I would contact a real estate attorney that is experienced in default real estate situations. In Los Angeles or in Orange County, California I would contact attorney Paul Horn who is also a CPA.
