California Civil sections 896 and 900 require builder to provide warranty for 1 year from close of escrow but a person or HOA can sue for construction defect in first 9 years 11 months 

In Utah - your state= the Davenport case is the rule which says builders give an implied warranty even if not in writing

yes, in MA, it's a one year warranty.... but there is flexibility with it....there are builders who attach an addendum to the p/s that spells out exactly what the length of time is for warranties for specific items/features/ building components of the home....

Great question, Wanda Kubat-Nerdin .  My husband is a builder and up until just a few years ago, the state of Oregon did not require any home warranty. Most reputable builders did warrant their product, but there was no requirement.  This did change and now the builder is required to warrant their new construction for a full year.  However, if something arises after that year that can be traced to builder issues, he/she is ultimately always on the hook for this, which is why Oregon requires a bond and insurance policy on every builder they license.

That's why all the HOAs sue them in year 9.

Here in NH there is no law that a builder has to give you a warranty. You can find some with none, some with 30 days, most with a year and some with more. Choose carefully is what i always say

I don't know the answer. However, I have done short sales for people who bought houses from builders who later filed bankruptcy which rendered their warranty useless and unenforcable.

In Arizona, I believe that a new home builder needs to provide a 2-year builder's warranty. Now if you mean an actual Home Warranty, home warranty companies generally will not issue them while there is any kind of a manufacturer warranty on an appliance, system or builder's warranty on the home.

Here in Utah it is state law the builders give a one year home warranty.  The builders call back the subcontractors who work on the houses to fix the problems. . . .

It is required in North Dakota Wanda Kubat-Nerdin and the licensing agency holds them accountable. It was a nightmare after our flood when all kinds of unskilled contractors and scammers flocked in.

In my market, typically, builders provide a 1-2 year warranty on major mechanicals (some do 5 years) and 10-25 years on structural items. I don't know that there is any requirement to do so... but it would probably be hard to sell the product without warranties. Builders here spend a lot of time "selling" their warranties versus their competition. And don't forget some of the warranties are from the manufacturers themselves (roofing, flooring, appliances).

Wanda yes new homes come with a 2 year builders warranty - not a home warranty company. They also are responsible for up to 10 years for defects etc.

What Caroline Gerardo said.  most builder will make good despite the fact that many owners need to follow up with many requests. Builders do not want their names and reputations trashed online.  We know how easy it is to let the world know how unhappy we are with ... anything and everything.

Wanda Kubat-Nerdin Here in Virginia there is a one year warranty required by law. It takes effect from the date of transfer of record title or buyer possession which ever occurs first. Five years on the foundation.
