In my state, only Designated Brokers have access to the legal hotline. I'm going to be watching for other answers, and hopefully more information. I would be shocked to know that a conversation between me and legal was ever divulged to anybody.

CAR Hotline is available to all members, I just used it last week.

I'd pursue the matter with higher ups at TAR to verify why they felt they had the right or duty to notify your broker. You've not shared what you discussed, so maybe they were right to do so, maybe they blew it?

Why didn't you contact your Broker first? As a broker I'd be very concerned as to WHY you had contacted a legal hotline instead of the person who's license you work under and may endanger with unauthorized practices. Perhaps that is there policy when an agent calls regarding this subject they call the broker. As a broker I'd be very thankful.

I'm not sure, but like Candice A. Donofrio and Bob "RealMan" Timm, our legal hotline is for designated brokers or agents who have gotten permission to call on behalf of the DB.  But if something is going on that might involve your E&O your broker should know because they will be involved as well. -Kasey

I was interested in the differences between Idaho, California & Texas so I just looked all three of them up.  It appears that notifying your broker is a term of use. TAR states this on the legal hotline page:

 

"The TAR Legal Hotline is a benefit exclusively for Texas REALTORS®. It is your link to an attorney who can provide information about real estate law and related matters. All Texas REALTORS® can call the hotline. The designated REALTOR® for your office will be notified by e-mail when you call."

Every call place with the legal hotline generates an automatic email to the broker.  Your privace was not violated they are just keeping your broker in the loop.  Did you first ask you broker about the coverage?

I'm not sure why they would even do that. But here in CA they always collect information about a caller. 

My question, why does it bother you? Why not to ask about insurance with your broker directly and request a copy of it?

I have ambivalent feelings about this one Mattye Smith -

On one hand, if I were phoning just to get some 'advice' on a topic that my BIC couldn't answer, I can see how you wouldn't want elements of your conversation shared. I would think that as a member, you've either signed a confidentiality agreement or something stating what information is deemed 'sharable' with your broker.

On the other hand, as a BIC, I would expect TAR to notify me about anything discussed with them by my agents they deem could be an E&O issue.  All agents may or may not be as responsible or forthcoming as you to report back to your BIC, something that they would need to know pertaining to E&O.  A BIC would like the opportunity to address, head-on, anything pertaining to an E&O claim.

I think it depends on the terms of use for the TAR - it would certainly annoy me if I were in your situation but I don't know what the TAR hot line represents itself to be.

I   discussed the situation with my broker, he did not know the answer.  The Attorney(assuming he was a lawyer) did not answer my question, he suggested that I contact the insurance company.  TAR, never advised me that they would alert my broker. What if my concerns were about the broker?  I never expected they would share my private information with someone else...even my broker, afterall we pay for these benefits..not the broker..

Let's turn this around.  If YOU were a Designated Broker, legally responsible for the actions of your agents, would you want to know if you have legal liability exposure through their actions?   I don't see this as a privacy issue.  I see it as a legal chain of responsibility issue.

I am curious, though, did the hotline ask if you had discussed the issue with your DM first?

These help lines are for Brokers.  You need to take your question there first and they can call the legal hot line if needed.  But if your Broker is worth their salt they will know the answer!

Every state is different. I am not aware that these calls are reported in TN to the brokers. Texas poilcy may be written somewhere that you missed.

On the surface it does seem inappropriate ... overstepping. I don't have enough information.  We need to know what the rules of engagement are. Perhaps what you discussed was "alarming" enough to reach out to the broker.  I don't know.

the attorney wants to know who to bill. Your agent called, the hours billed to broker account.

Or, you used a trigger word that put others things in motion.

Is it a violation of your privacy? Of course. So you'll need your own attorney to prove it a violation of the LAW.
