If NO ONE has hired you, still no problem. You have no role in the transaction and should refrain from injecting ANY professional guidance.

If the professional involved is screw-up, has little experience, has no experience working with both the buyer and seller side, the problems that exist are countless.

However, the laws of your state may have a different point of view.

Michael DeVico As long as the customer understands exactly what unrepresented means and is provided full disclosure, there shouldn't be any problems. I will venture to say once they fully understand what it means to be unrepresented, they will sign an Agency agreement and go with full representation.

Interesting question...an unrepresented customer may wish they had representation along the way or when it is all said and done. Best to do it on the front end.

You do all the work and probably won't get paid, but then again that would be my fault for not having them sign a buyer representation agreement... so bottom line, I wouldn't take any one out without representation.

A lot can be written about this. You have to be very careful in this situation. Often the unrepresented person will feel like you are their agent. Full disclosure stating you aren't needs to be given to that person.

None. Agency disclosure is required in NY state. I must represent either buyer or seller or dual. However, I can represent either buyer or seller and deal with unrepresented customer.

As a seller's agent I do not represent the interest of the buyer. In dealings with buyer customers as a seller's agent I (a) exercise reasonable skill and care in performance of my agent's duties, (b) deal honestly, fairly and in good faith; and (c) disclose all facts known to me materially affecting the value or desirability of property.

Buyer signs NY agency disclosure form acknowledging I am a seller's agent and represent interest of seller.

As a buyer's agent I represent the interest of the buyer. In dealings with a seller customer (unrepresented aka FSBO) I (a) exercise reasonable skill and care in performance of my agent's duties; (b) deal honestly, fairly and in good faith; and (c) disclose all facts known to me materially affecting the buyer's ability and/or willingness to perform a contract to acquire seller's property that are not inconsistent with my fiduciary duties to the buyer.

Seller signs NY agency disclosure form acknowledging I am buyer's agent and represent the buyer's interests.

Real estate is local and local laws apply.
