I don't understand your question. In the first sentence you say "My seller", and then in the 4th paragraph you say "The issue for my buyer". Who do you represent and who want to change the closing date?

I'm not sure what state your in because that would make all the difference. Obviously not an attorney state or they would be handling this nonsense.
If the closing date is not changed the buyers can't perform right? Financing doesn't go thru then they get their EM back right?
Start playing hard ball - just work with what is best for your buyers. You're not saying why it needs to get an extension. Hope it's not a stupid reason like a full moon.

Talk to your broker, that is why they get a portion of your commission.

Do you represent the Seller or the Buyer?
Who does not want to sign an addendum changing the closing date?

I have no idea why a seller wouldn't sign if asked in advance to close at a different date without giving you a real reason. But your question is confused, whom do you represent, seller or buyer?

Looks to me like you need to redouble your efforts to get your buyers deal closed by the original closing date.

As broker/manager I dealt with many such issues. Not easy to change dates but not impossible. As for your broker/manager's help. Good luck.

You can not be 'wishy washy" when setting closing dates, if you need a week, take the week, if not... dont ask for it and then say we may be able to close on time. Customers want firm dates, i prob would not have my client sign such a request either

Next time, get the date right in your contract.

Your question is unclear with respect to who you are representing. Perhaps legal advice should be sought.

The seller feels no need toextend the date with so much time between now and then. If you say it is worse case and it may close earlier then the seller is counting on that. It is a matter of putting some fire under the feet of your buyer.

Certainly puts the pressure on your buyers, most likely they will extend it but it does put your buyers at risk.
I am sure that all want this to close, but few like delays.
Do you still have any unsatisfied contingencies or would you be at the same risk of losing your deposit today as you would be closer to the closing date?

This stuff happens. That's why it's so important for us to keep our buyers and their lenders on the time line.

Most sellers don't want to extend the closing until something for sure is wrong. That's common. Give the bank 30 days, they'll take 40. Give them 60, they'll take 80. Banks suck. The bigger they are, the more they suck.
Personally, I'd have rejected the addendum too. Once your contingencies are removed (in Cali) your deposit is gone anyways, so the date of closing doesn't matter.

I do not understand the question. I am with Richard Weeks on this. There are many helpful professionals in the community who love to help. We just need to connect the dots and understand what the real issue is. We simply need more ... clarification.

My guess is that when an extension is signed with the possibility of still adhering to the original, earlier close, 10x out of 10, the later closing date is what wins. If lenders have more time to close, they will grab it and run. Seller just wants the lenders to "move it" to make it happen.

Tammy Hansen - I'd say, everything is possible! Just take the right approach - and you should be the best person to know about the situation.
Good Luck.

Each state is different in how things are handled. I had what sounds like a similar situation where I had the buyers. They had to change the closing the date. The agent on the other side was being difficult. I put wording in the addendum that if the sellers didn't sign it by such and such date, then all earnest money would be refunded and the transaction would be over. This seemed to get the message through to the agent, that we weren't going to have a closing unless the other side cooperated. We laid it all out and made it very obvious the buyers would walk and the other side wouldn't even have the earnest money to console them.
This was a case of the agent letting her ego get in the way of the sale. I made it happen.
Maybe what you need to do is check with your broker on this situation.

Your question is very confusing...are you doing both sides of this since you mention my seller and my buyer? My guess is that the seller thinks the extension is being requested prematurely since closing is nearly two weeks away but you need to be more specific in your question. Have you talked to your broker?
