Cant' really tell you but I would check with the laws in your state. I imagine they vary from state to state. our local title company would be another good resource. And quite frankly I can't remember some of this stuff from my licensing classes! Good luck

All state property laws are specific to that state.  The buyer and Seller should discuss property rights with an attorney licensed in their state.
