Hawaii was an early adopter of medical maijuana legalization. Our laws continue to evolve. Some stipulations include the same "no smoking" restrictions in shared common elements like a condo complex lobby, renter's right to smoke in the privacy of his/her dwelling, etc.

This is a big issue in Colorado. There is no law that gives a medical marijuana tenant the right to smoke pot in a house where smoking isn't allowed. Colorado is still trying to work through some legal areas, but as long as pot stays illegal on the federal level, that makes it easier for landlords and property owners. And that's because they can always defer to the federal laws. Insurance also becomes an issues. It's an involved and evolving situation in my state. I find it all very interesting.

Washington is a legal marijuana state but we are still struggling how to regulate it.  I haven't followed the ins and outs of it all.  Am I the only person in the world left that has never used marijuana in any form?  Sometimes I wonder if I should just so I can understand what the big deal is.  LOL

I'm not aware of any laws in FL that allow or prohibit this for tenants - but I imagine this could be an issue for neighboring tenants

We have a lot of mold and electrical issues in pot rentals so most landlords are not allowing it, and homeowners are in danger of having their mortgage called due for knowingly allowing the breaking of federal law, regardless of it being legal in the state. Can't imagine many lenders will pull that card, but it's often a reason owners are saying 'no.'

Pretty much what you wrote.    It's still smoking, so I won't allow that inside my rentals (smoking on the patio is ok).  In some parts, they're outlawing (or already have) smoking indoors period! 

It's still illegal federally, so I don't allow the cultivation of it or the possession of it.  I don't want my doors broken down on a raid.  The next version of my rental addendum will include that out along with meth and other drugs.  Currently it's not expressly forbidden, but it is covered under the state's non-smoking clause in the contract and they would forfeit their deposit.

I appreciate everyone's input! In California a bill has passed the Assembly and is in the State Senate that would allow landlords to prohibit the smoking of medical marijuana and would make it illegal to smoke anywhere smoking is already legal. The bill has bipartisan support, so I expect it to pass and hit the governor's desk. I would bet other states will codify similar landlord rights as many of you have mentioned concerns about smoking or an impact on neighbors.
