I've actually had to send my listing agreement to the MLS to clear up a point or be fined. I PREVAILED. To me, that's giving the board's MLS way too much power over our contractural agreements.

We have a couple of different ways:  formal where everybody signs on a cancellation form with the date.

My office will take an email that says from both sides - we agree to cancel on such a date.  Go to MLS, click cancelled or withdrawn.

We are supposed to have the written authorization for all changes to the listing.  The Florida Real Estate Commission will do occasional audits and check.

Out here in my little association, you don't have to turn in any paperwork unless the seller wants to keep the listing out of the MLS.  Everything else is just between the agent and the client.

All we do is do an amendment to the lisitng agreement and an MLS change form. Then the broker can withdraw it.

You have to get anything in writing about the withdrawing ( not the same as cancellation in here), but it is not for mls, they usually do not check.

One should get a written notice even an eMail that the seller wants out.

As for agreement between seller and agent when the seller can sell w/o paying a commission during that time. It is up to the broker. Sellers met buyers and want to strike a deal direct by firing listing agent has happened in the past. Other times another listing wants the listing by letting first agent go to get his listing as new listing agent.  One needs to protect herself.
