In my jurisdiction, multiple representation is the term used for dual representation and it is at the brokerage level.  Thus, it can be common for multiple representation to occur.

In my practice, I do not do dual agency under any conditions.  I certainly wouldn't advise an inexperienced agent to try it.  In many states, it is illegal.

Yes.  If I have the Seller and I also have a Buyer Agency relationship with a buyer that is a perfect match ... that becomes a dual represented transaction.  I know my first thought would be, "but itsn't there a conflict of interest?"  My answer to that, "not if you are able to draw a line down the middle and be open, fair and honest with all parties.  I believe the  fiduciary duty of "confidentiality" protects us so that as long as we explain to both parties (buyer and seller) our duties and they know how it works there should not be an issue.  I've been doing it for 22 years and honestly?  I have never had a buyer or seller say to me that I did not treat all parties fairly; nor was I accused of treating one over the other.  It's all in how you understand your duties to "all parties".

my experience has been either 1) it made the tranastion go much smoother...  or 2) was a nightmare... usually its one if the agent is great. because they are great for both sides.and everything is "tempered" no bomb throwing!

In California when buyer and seller are represented by the same brokerage that is dual agency.   I currently work for the largest brokerage in my area so that has happened.
