Why would it be a violation? Nobody's conspiring with anybody. Now if the email had said that we and several other brokers in the area decided to charge a 3% commission... that would be a violation. Brokers are free to choose to charge whatever they want. It's when they all get together to set a firm rate (price fixing)  is where they get into trouble.

What was their business?  Who were they trying to attract?  As long as they weren't trying to set commissions with other business, I think they are ok.  Possibly RESPA depending on the business?

I don't think it would be...if they are a related business they are not a real estate agent and the commission they pay has nothing to do with real estate commission.  An attorney would need to weigh in on this, like Lise Howell?

What exactly are you calling a "related business"? And is it owned by your company? Or are you referring to what we call "affiliates" (non-real estate businesses) that provide ancillary services to REALTORS?

The closest I've seen to this is Toll Bros advancing a % commission when a new construction house goes under contract. I suppose they could pay 3% if they wanted.

David Barr No, we used to have a company here called 4% Realty. They had no problem getting an approved firm license from the real estate commission.
