One buyer tried to sneak pass, however, the sales representative knew and I was with the buyer once. She made it a point that the buyer does not play that game - and I was compensated.

Fortunately, I've not had this issue pop up. I give all my new construction clients stacks of my business cards to leave at the sales offices and tell them to make sure the card is staped to their registration form. Probably 75%, if not more, of new construction sales in our area are generated by agents, so the builders don't look to make us mad.

Yes, once a client's wife went in and registered a couple of hours before our appointment at the project. The builder would not honor my registration. Lucvkily my buyer was loyal and bought a home at the project next door!

That hasn't happened to me yet.  I tell my clients to let me know when they are going to a new home community so I can go with them on their first visit I also give them a few of my cards to give to the sales counselor upon their initial visit to the new home community if I am not available.  I have also called the sales office to let the couselor know that my clients will be coming in to visit with him/her about purchasing a new home and that I will be following up with them after their visit.

I have not but I have heard of agents that have. We don't have neighborhoods like this where the builder captures the business. Individual agents work the open houses and we all know one another.

This has happened, and told my clients I could not represent them, and they never did write a contract with that builder.   It has happened where I lost the transaction too.

Paul - I had a client I had been working with for a year all of a sudden decide they wanted a new build, and didn't tell me. They went to the builder on their own and didn't even notify them they were working with an agent.

I think they thought they were going to get some special deal if they didn't have me representing them.

I didn't even get a chance to register them, and no, I did not have a buyer broker agreement because it had expired and I did not make them sign a new one.

No; good thing you had your Buyer Agency agreement. In CT, it is mandatory to have one (unless buyers refuse to sign, which needs to be documented too). Some sellers' attorneys started asking to see those agreements at closings before paying our the commission.

Well, if the client confirms your role in this transaction, it should not be any issues. Also, I always keep emails/texts with a client that prove my engagement.

i have heard of that happening. if i were a builder (i am) and the agent wasnt involved and claimed it was their buyer after the fact that the selling agent has done a bunch of work...i think it is no different than a agent sending a buyer to a open house without them because they are "busy" i think they need to be there. . do their job. i know this wont be popular. now if the agent called me at the sales office and said mr and mrs jones will b coming thru this pm, i am out of town and they will be touring the homes. i will follow up with you via email this evening after their visit.

In CA this is the standard practice.  If the client comes in before you call the showroom, you're SOL.  That's of course assuming the builder even coorperates with agents.  That must be a rare thing because I've heard a local builder going out of their way to emphasize that they work with agents.
